These Terms of Use (the "Terms") are a binding agreement between you and Innosight ("we", "us", "our"), the developer and operator of the Madee's Farm game (the "game"), the website madeesfarm.com and the related online services (together, the "Services"). By downloading, installing or playing the game, or by tapping "ACCEPT & CONTINUE", you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who may play
1.1 You must be at least 13 years old to use the Services.
1.2 If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services, including any purchases.
1.3 You may not use the Services if you are barred from doing so under the laws that apply to you, or if we have previously banned your account.
2. Your account
2.1 Guest account. When you first open the game we create a guest account linked to your device. If you remove the game or change devices without linking your account to Sign in with Apple or Google, you may lose access to your account and farm, and we cannot guarantee that we will be able to restore it.
2.2 Linking. We recommend linking your account to Sign in with Apple or Google so you can recover it on another device. You are responsible for keeping access to your Apple or Google account secure and for everything that happens under your game account.
2.3 Personal use. Your account is personal. You may not sell, buy, rent, give away, share or transfer accounts, or offer or use any service to do so. One person should use one account; creating additional accounts to collect rewards, gifts, help or invitation bonuses, or to move goods or coins to another account, is not allowed.
2.4 Names. Your player name, your animals' names and the names and mottos of neighbourhoods you create must not be offensive, hateful, sexual, misleading or infringe anyone's rights, and must not impersonate another person, Innosight or our staff. The game refuses names on our list of offensive words, and we may change or remove any name that breaks these rules.
2.5 Deleting your account. You can delete your account at any time in the game (Profile → DELETE ACCOUNT). Deletion is permanent: your farm, coins, gems and items are removed and cannot be restored or refunded.
3. Licence to use the game
3.1 Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the game on devices you own or control, for your own personal, non-commercial entertainment.
3.2 You may not, and may not help anyone else to:
- copy, modify, translate, decompile, disassemble or reverse engineer the game or the Services, except where the law expressly allows it;
- use cheats, bots, scripts, automation, modified game clients, changed device clocks, or any software or method that gives an unfair advantage or interferes with how the game works;
- exploit bugs, errors or design flaws instead of reporting them to us;
- access or attempt to access our servers, data or accounts other than through the game as intended, overload them, or interfere with their security;
- collect data about other players, or use the Services for advertising, spam or any commercial purpose;
- remove or alter copyright, trademark or other notices;
- use the Services in any way that breaks the law.
4. Virtual currency and items
4.1 The game contains virtual items such as coins, gems, crops, goods, materials, animals, pets, buildings, decorations, farm styles and other content ("Virtual Items"). Some Virtual Items can be earned by playing, some may be bought with real money, and some may be available only through purchase.
4.2 Virtual Items are licensed to you, not sold. They have no monetary value, cannot be exchanged for real money, goods or services, and are not your personal property. They can be used only in the game and only on the account that received them.
4.3 You may pass Virtual Items to other players only through the features the game offers for that purpose (for example your roadside stall and newspaper, neighbourhood requests and donations, and gifts between friends). You may not buy, sell or trade Virtual Items or accounts for real money or anything outside the game, on any marketplace or platform.
4.4 We may manage, change, rebalance, limit or remove Virtual Items, prices, rewards, odds and game features at any time, for example to keep the game fair and balanced. Where the law requires it, we will give you reasonable notice of changes that significantly affect Virtual Items you paid for.
4.5 Virtual Items are lost when your account is deleted, closed or terminated under these Terms, and when the Services end. Except where the law or the rules of the store you bought from require otherwise, Virtual Items are not refundable.
4.6 Some features, such as the daily wheel, mystery boxes, the mine and golden crops, give random rewards. These rewards are Virtual Items only; the game does not offer gambling or prizes with real-world value.
5. Purchases
5.1 Purchases are made through the Apple App Store or Google Play and are subject to the payment, pricing and refund terms of that store. We do not process payments and never receive your card details.
5.2 Prices are shown in the store and may change. Taxes are included or added as the store decides.
5.3 After a successful purchase we deliver the Virtual Item to your account. Items kept for good, such as decorations and farm styles, belong to the account that paid for them; to keep them on a new device, link that account to Sign in with Apple or Google. If an item you paid for does not arrive, contact support@madeesfarm.com with your player code and the purchase details; if we confirm the problem, we will deliver the item or re-issue it.
5.4 Refunds are handled by the store under its policies (for the App Store at https://reportaproblem.apple.com). If a purchase is refunded or reversed, we may remove the Virtual Items it delivered, or their equivalent, from your account.
5.5 Right of withdrawal (EU, UK and similar laws). Virtual Items are digital content supplied immediately after purchase. By completing a purchase you ask us to supply the content at once and acknowledge that, as a result, you lose your right of withdrawal once delivery has started, to the extent the law allows.
5.6 Parents and guardians are responsible for purchases made by minors in their care. We recommend using your device's purchase controls (for example Screen Time on iPhone).
6. Advertising and rewards
6.1 The game is free to play and shows ads provided by Google AdMob, as explained in our Privacy Policy.
6.2 Some ads are optional "rewarded" ads: when you watch one to the end, you receive the reward shown before the ad. Rewards depend on ad availability, and we may change them. You must not use tools that fake ad views or block ads to obtain rewards.
7. Chat, neighbourhoods and other players' content
7.1 No tolerance for objectionable content or abusive users. Madee's Farm is a friendly game for a general audience. In neighbourhood chat, names, mottos and anything else other players can see, you must not post anything that is hateful, harassing, threatening, sexual, violent, discriminatory, illegal, spam, advertising, or that shares anyone's personal information (including your own).
7.2 Filtering. The game filters chat and names automatically: offensive words are replaced by stars, and offensive names are refused. The filter cannot catch everything, so please report what it misses.
7.3 Reporting and blocking. You can report a player's name or chat message with the REPORT button, and block a player with the BLOCK button, after which you no longer see their messages, visits or gifts. You can unblock players in Settings.
7.4 What we do. We review reports, and we aim to act on them within 24 hours: we remove content that breaks these Terms, and we may rename, restrict or ban the player who posted it (section 10).
7.5 Content other players post is theirs, not ours; we do not check it before it appears, and we are not responsible for it, but we act on it as described above.
8. Fair play and conduct
8.1 You agree not to:
- cheat, use bots or modified clients, or change your device's clock to speed up the game;
- harass, threaten, insult or abuse other players or our staff, including through names, chat, gifts or support messages;
- create multiple accounts to abuse gifts, help, likes, neighbourhood rewards, invitation rewards or other features;
- sell or advertise accounts, Virtual Items or boosting services;
- pretend to be Innosight, our staff or another player;
- attempt to obtain other players' account access or personal data.
8.2 Please report cheating, bugs and abusive behaviour with the REPORT button, through the support screen in the game, or at support@madeesfarm.com.
9. Online play
9.1 Your farm is kept on our server. Saving your progress and features such as friends, neighbourhoods, chat, the market, gifts and leaderboards require an internet connection. You are responsible for the cost of your internet connection.
9.2 Actions you take while offline are sent to our server when you are back online, and our server checks them. Actions it cannot accept — for example ones made with a changed device clock, or after too long a time offline — are not kept, and your farm returns to the last state our server confirmed.
9.3 Leaderboards, neighbourhood races and events may be reset, recalculated or corrected, for example after cheating is removed.
10. Enforcement, suspension and termination
10.1 If we reasonably believe you have broken these Terms or the law, or that your account puts other players or the Services at risk, we may, depending on how serious the breach is: warn you; remove content; change your player, animal or neighbourhood name; remove or reset Virtual Items, rewards, rankings or progress obtained improperly; restrict features such as chat; or suspend or permanently ban your account. Where reasonable we will tell you why.
10.2 A banned account cannot sign in or play, but you can still contact support from the game to ask us to review the decision. We will review every such request.
10.3 We will not refund Virtual Items or purchases lost because of a suspension or ban for breaking these Terms, except where the law requires it.
10.4 You can stop using the Services at any time and delete your account in the game.
11. Content you send us
11.1 Your names, chat messages, support messages, bug reports and suggestions ("your content") remain yours. You give us a worldwide, royalty-free licence to use, store, display and process your content as needed to run and improve the Services, including showing your chat messages to the members of your neighbourhood.
11.2 If you send us ideas or feedback, we may use them freely without any obligation to you.
11.3 We may remove or edit any content that breaks these Terms.
12. Intellectual property
The game, the website and all of their content — including the software, art, characters (including Madee), names, music, sounds, text, logos and the "Madee's Farm" name — are owned by Innosight or its licensors and are protected by copyright, trademark and other laws. Except for the licence in section 3, these Terms give you no rights to them.
13. Third-party services
The Services use third-party services such as Apple (App Store, Sign in with Apple), Google (Google Play, Sign in with Google, Firebase, AdMob) and Unity. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.
14. Changes to the game and to the Services
14.1 We continually update the game. Updates may add, change or remove features, content and Virtual Items. Some updates are required: an old version of the game may stop working until you install the latest one.
14.2 We may suspend the Services for maintenance, or stop offering the game or any part of it. If we decide to permanently end the game, we will give at least 30 days' notice in the game or on our website.
14.3 We work hard to keep the Services available, but we do not guarantee that they will always be available, uninterrupted or error-free.
15. Disclaimer
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services or your progress will be free of errors, loss or interruption. Nothing in these Terms affects rights you have as a consumer that cannot be excluded or limited by contract under the law of the country where you live.
16. Limitation of liability
16.1 To the fullest extent permitted by law, Innosight, its affiliates, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, Virtual Items or progress, arising out of or related to the Services or these Terms.
16.2 To the fullest extent permitted by law, our total liability to you for all claims relating to the Services is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, and (b) 50 US dollars.
16.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law.
17. Indemnity
To the extent permitted by law, you agree to compensate Innosight for claims, losses and reasonable costs (including legal fees) caused by your breach of these Terms or your misuse of the Services.
18. Governing law and disputes
18.1 These Terms are governed by the laws of the Republic of Azerbaijan, without regard to its conflict of laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.
18.2 If you have a problem with the Services, please contact us first at support@madeesfarm.com. Most problems can be solved quickly this way. You and we agree to try to resolve any dispute informally for at least 30 days before starting formal proceedings.
18.3 If the dispute is not resolved, it may be brought before the courts that have jurisdiction under the applicable law. If you live in the European Union, you can also use the courts of your country of residence.
19. App Store terms
If you downloaded the game from the Apple App Store, the following also applies:
- These Terms are between you and Innosight only, not with Apple Inc. ("Apple"). Innosight, not Apple, is solely responsible for the game and its content.
- Your licence to use the game is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may also be used by other accounts associated with you through Family Sharing.
- Apple has no obligation to provide any maintenance or support for the game.
- If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the game (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the game.
- Innosight, not Apple, is responsible for addressing any claims by you or a third party relating to the game or your possession and use of it, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the game or your possession and use of it infringes that third party's intellectual property rights, Innosight, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example your mobile data provider's) when using the game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
- Questions, complaints or claims about the game should be sent to Innosight at support@madeesfarm.com.
20. Changes to these Terms
We may update these Terms when the Services or the law change. Each version has a number and an effective date at the top. If we make important changes, the game will ask you to accept the new version before you continue playing. If you do not agree to the new Terms, you must stop using the Services and may delete your account. The current version is always available in the game (Settings → TERMS) and at https://madeesfarm.com/terms
21. General
21.1 These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
21.2 If any part of these Terms is found invalid or unenforceable, the rest remains in force, and the invalid part is replaced by a valid provision as close as possible to its original intent.
21.3 If we do not enforce a provision immediately, we have not waived our right to do so later.
21.4 You may not transfer your rights or obligations under these Terms. We may transfer ours to a company that takes over the game, provided your rights are not reduced.
21.5 These Terms are written in English. If we provide a translation, the English version prevails in case of any difference, unless the law where you live requires otherwise.
